Privacy Policy

We process personal data (hereinafter mostly referred to as “data”) only to the extent necessary and for the purpose of providing a functional and user-friendly website, including its contents and the services offered there.

According to Article 4(1) of Regulation (EU) 2016/679, the General Data Protection Regulation (hereinafter referred to as “GDPR”), “processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or linking, restriction, erasure or destruction.

With the following data protection declaration, we inform you in particular about the type, scope, purpose, duration and legal basis of the processing of personal data, insofar as we decide on the purposes and means of processing either alone or jointly with others. In addition, we inform you below about the third-party components we use for optimization purposes and to improve the quality of use, insofar as third parties process data under their own responsibility.

Our privacy policy is structured as follows:

  1. Information about us as controllers
  2. Rights of users and data subjects
  3. Information on data processing
  4. cookies

Information about us as controllers

The responsible provider of this website in terms of data protection law is:

Rights of users and data subjects

Data subjects in the narrower sense are in particular users/visitors of our platform, registrants, registered persons, customers or other persons whose personal data we collect, process and/or store. With regard to the data processing described in more detail below, users and data subjects have the right

  • to confirmation as to whether data concerning them is being processed, to information about the data being processed, to further information about the data processing and to copies of the data (see also Art. 15 GDPR);
  • to rectification or completion of incorrect or incomplete data (see also Art. 16 GDPR);
  • to the immediate erasure of data concerning them (see also Art. 17 GDPR), or, alternatively, if further processing is necessary pursuant to Art. 17 Para. 3 GDPR, to the restriction of processing in accordance with Art. 18 GDPR;
  • to receive the data concerning them and provided by them and to transmit this data to other providers/controllers (see also Art. 20 GDPR);
  • to lodge a complaint with the supervisory authority if they are of the opinion that the data concerning them is being processed by the provider in violation of data protection regulations (see also Art. 77 GDPR).

Furthermore, the provider is obliged to inform all recipients to whom data has been disclosed by the provider of any rectification or erasure of data or restriction of processing carried out pursuant to Articles 16, 17 (1) and 18 of the GDPR. However, this obligation does not apply if this notification is impossible or involves disproportionate expenditure. Notwithstanding this, the user has a right to information about these recipients.

Likewise, according to Art. 21 GDPR, users and data subjects have the right to object to the future processing of data concerning them, provided that the data is processed by the provider in accordance with Art. 6 (1) (f) GDPR. In particular, an objection to data processing for the purposes of direct advertising is permissible.

By using our websites and using our advertising services and our services, you accept this privacy policy and expressly consent to the collection, use, storage and protection of your personal data as described in this privacy policy.

You also have the right to revoke your declaration of consent under data protection law at any time. The revocation of the consent does not affect the legality of the processing carried out on the basis of the consent until the revocation (Art. 7 Para. 3 GDPR).

Please note that with such requests we have to ensure that it is actually the person concerned. To ensure data security for our customers, in the event of a revocation it is therefore necessary that the person revoking the consent authenticates themselves using meaningful identification documents. Your personal data (telephone number, email address, place of residence, images, ad texts) will then be deleted immediately from our customer system - taking into account the retention periods under tax and commercial law.

Handling of customer data

Personal data such as name, address, telephone number, email address and images are only collected and processed if you provide this information voluntarily, in particular as part of an inquiry, advertisement placement or other order. Data is stored in our system, which is not accessible to unauthorized third parties. We only pass on this data if this is necessary to fulfill our contractually owed services. Any further use of personal data and the collection of additional information requires the separate consent of the person concerned.

If we link websites to each other, the advertising-related publication of your data that you have provided to us may take place automatically on other websites or subpages.

If you commission an ad to be placed, personal information about our advertising customers may also be published on social networks. This automated process may be part of our contractual additional services and serves the purpose of promoting the customer's advertising. However, not all data that is made available to us when the order is placed and the ad is placed is transmitted to social networks. In principle, the information forwarded can include the name, ad images, ad texts, news and the time of publication. You can find more information about the use of data by social networks, setting options and objection options on the website of the respective network.

Minors

Our offer is fundamentally aimed at adults. Persons under the age of 18 are prohibited from sending us personal data.

Information on data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose of storage no longer applies, there are no statutory retention periods that prevent the deletion of the data and no other information is provided below regarding individual processing procedures.

Server data

For technical reasons, in particular to ensure a secure and stable Internet presence, data is transmitted to us or to our web space provider through your Internet browser. These so-called server log files collect, among other things, the type and version of your Internet browser, the operating system, the website from which you accessed our Internet presence (referrer URL), the website(s) of our Internet presence that you visit, the date and time of each access, and the IP address of the Internet connection from which you access our Internet presence.

The data collected in this way is temporarily stored, but not together with other data about you. This storage takes place on the legal basis of Art. 6 Paragraph 1 Letter f) GDPR. Our legitimate interest lies in the improvement, stability, functionality and security of our website. The data is deleted after seven days at the latest, unless further storage is required for evidentiary purposes. Otherwise, the data is fully or partially excluded from deletion until the incident has been finally resolved.

Security of your data

The personal data you provide to us is secured by taking all technical and organizational security measures to ensure that it is inaccessible to unauthorized third parties. When sending very sensitive data or information, we recommend using the postal service, as complete data security cannot be guaranteed via email.

Cookies

  1. a) Session cookies

We use so-called cookies on our website. Cookies are small text files or other storage technologies that are stored on your device by the Internet browser you use. These cookies process certain information about you on an individual basis, such as your browser or location data or your IP address.

This processing makes our website more user-friendly, effective and secure, as the processing enables, for example, the display of our website in different languages or the offer of a shopping cart function. The legal basis for this processing is Art. 6 Para. 1 lit. b.) GDPR, provided that these cookies process data for the purpose of initiating or executing a contract.

If the processing does not serve to initiate or execute a contract, our legitimate interest lies in improving the functionality of our website. The legal basis is then Art. 6 Para. 1 lit. f) GDPR. These session cookies are deleted when you close your internet browser.

  1. b) Third-party cookies

Our website may also use cookies from partner companies with whom we work for the purposes of advertising, analysis or the functionality of our website.

For details, in particular the purposes and legal basis for processing such third-party cookies, please see the information below.

  1. c) Possibility of removal

You can prevent or restrict the installation of cookies by adjusting the settings on your Internet browser. You can also delete cookies that have already been saved at any time. The steps and measures required to do this depend on the specific Internet browser you are using. If you have any questions, please use the help function or documentation for your Internet browser, or contact the manufacturer or support. However, in the case of so-called Flash cookies, processing cannot be prevented via the browser settings. Instead, you must change the settings on your Flash player. The steps and measures required to do this also depend on the specific Flash player you are using. If you have any questions, please use the help function or documentation for your Flash player, or contact the manufacturer or user support.

However, if you prevent or restrict the installation of cookies, this may mean that not all functions of our website are fully usable.

Contract Execution

The data you provide to use our products and/or services will be processed by us for the purpose of contract execution and are necessary for this purpose. Contract conclusion and contract execution are not possible without the provision of your data.

The legal basis for the processing is Art. 6 Para. 1 lit. b) GDPR.

After the contract has been fully processed, which usually ends after an ad has been placed - if you deactivate the respective profile or ad, we will remove the publicly provided data from our website. In doing so, we observe retention obligations under tax and commercial law. Data is stored in our customer system for as long as it is necessary for its contractual purpose. Due to any recurring follow-up orders, data may be stored in our customer system until the time of revocation of your consent. Any provision of your data, for example on sub-pages or third-party sites, may take place until the time of revocation of publication.

Due to the large number of visits to our platform by users and third parties, we cannot rule out that information you provide, such as your name or telephone number, will be copied, duplicated, stored or passed on. As a result, we cannot guarantee the complete security of your data from the time it is published.

As part of the contract processing, we will pass on your data to the financial service provider commissioned with the processing, insofar as the transfer is necessary for payment purposes.

The legal basis for the transfer of data is then Art. 6 Para. 1 lit. b) GDPR.

Customer Account / Registration Function

If you create a customer account/user account with us via our website, we will collect and store the data you entered during registration (e.g. your name, address or email address) exclusively for pre-contractual services, for the performance of the contract or for the purpose of customer care (e.g. to provide you with an overview of your previous orders/bookings with us or to be able to offer you the so-called wish list function). At the same time, we then store the IP address and the date and time of your registration. This data will not be passed on to third parties.

As part of the registration process, your consent to this processing will be obtained and reference will be made to this privacy policy. The data we collect will be used exclusively to provide the customer account.

If you consent to this processing, Art. 6 (1) lit. a) GDPR is the legal basis for the processing.

If the opening of the customer account also serves pre-contractual measures or the fulfillment of the contract, the legal basis for this processing is also Art. 6 (1) (b) GDPR.

You can revoke the consent you have given us to open and maintain a customer account at any time with future effect in accordance with Art. 7 Paragraph 3 GDPR. To do so, you simply need to notify us of your revocation. (see below)

The data collected in this regard will be deleted as soon as processing is no longer necessary. However, we must observe retention periods under tax and commercial law.

Objection Options

Unless there are any necessary reasons in connection with a business transaction, you have the option of revoking your previously granted consent to the storage of personal data with immediate effect in writing (e.g. by email or fax) at any time (according to Art. 21 GDPR). In order to guarantee the data security of our customers, in the event of a revocation it is necessary for the revoking person to authenticate themselves using identification documents. Your personal data (telephone number, email address, images, ad texts, etc.) will then be deleted immediately from our customer system - taking into account the retention periods under tax and commercial law.

Important changes to your data must be communicated in writing.

Newsletter

If you register for our free newsletter, the data requested from you, i.e. your email address and - optionally - your name and address, will be sent to us. At the same time, we save the IP address of the internet connection from which you access our website as well as the date and time of your registration. As part of the further registration process, we will obtain your consent to send you the newsletter, describe the content in detail and refer you to this privacy policy. We use the data collected exclusively for sending the newsletter - it is therefore not passed on to third parties.

The legal basis for this is Art. 6 Para. 1 lit. a) GDPR.

You can revoke your consent to receive the newsletter at any time with future effect in accordance with Art. 7 Paragraph 3 GDPR. To do so, you simply need to inform us of your revocation or click on the unsubscribe link included in each newsletter.

Contact Requests / Contact Options

If you contact us via the contact form or email, the data you provide will be used to process your request. Providing the data is necessary to process and answer your request - without providing it, we cannot answer your request or can only answer it to a limited extent.

The legal basis for this processing is Art. 6 Para. 1 lit. b) GDPR.

Your data will be deleted if your request has been conclusively answered and there are no statutory retention periods that prevent deletion, such as in the case of a possible subsequent contract processing.

Personal data that is processed as part of registrations or when using the contact form during the sending process serves to prevent misuse of the contact form and to ensure the security of our systems. IP addresses are stored for the purposes of the legal requirements placed on us as website operators. IP addresses must be verifiable so that they can be checked in criminal cases. In addition, the collection of this data is necessary in order to be able to offer our services at all.

We will not pass on data to third parties without your consent unless we are legally obliged to do so or the transfer serves to clarify a legal violation.

User Contributions, Comments and Ratings

We offer you the opportunity to publish questions, answers, opinions or reviews, hereinafter referred to as "contributions", on our website. If you take advantage of this offer, we will process and publish your contribution, the date and time of submission and any pseudonym you may use. Your full name will therefore only be visible to other users if you enter it as your user name during registration. If you do not want your real name to be published, we recommend that you select a pseudonym.

The legal basis for this is Art. 6 Para. 1 lit. a) GDPR. You can revoke your consent at any time with future effect in accordance with Art. 7 Para. 3 GDPR. All you have to do is inform us of your revocation.

In addition, we also process your IP and email address. The IP address is processed because we have a legitimate interest in initiating or supporting further steps if your contribution infringes on the rights of third parties and/or is otherwise unlawful.

The legal basis in this case is Art. 6 (1) (f) GDPR. Our legitimate interest lies in the legal defense that may be necessary.

Google Analytics

We use Google Analytics on our website. This is a web analysis service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter referred to as "Google". Google Analytics is a tool for analyzing website traffic. Our goal is to offer you the best possible service. The data from Google Analytics helps us to provide an accurate picture of the strengths and weaknesses of our website and helps us to better understand our visitors. This enables us to make targeted improvements in order to offer you the best possible service. Using a tracking code, Google Analytics generates a random, unique ID that is linked to your browser cookie to identify you as a new user. On subsequent visits, you will be recognized as a "returning" user.

The following cookies are used by Google Analytics:

Name: _ga Purpose: By default, analytics.js uses the cookie _ga to store the user ID. Basically, it is used to distinguish between website visitors.

Name: _gid Purpose: The cookie is also used to distinguish between website visitors

Name: _gat_UA-* Purpose: This is a pattern type cookie set by Google Analytics, where the pattern element in the name contains the unique identity number of the account or website it refers to. Name: _ga_* Purpose: These cookies collect information about the website behavior of users for analysis purposes, which is used to create statistics (analysis and statistics function)

Please note that this list is not exhaustive, as Google regularly changes its cookie selection.

The use of Google Analytics requires your consent, which we obtain through a cookie pop-up. According to Article 6 Paragraph 1 Letter a of GDPR (consent), this consent represents the legal basis for the processing of personal data. In addition, we have a legitimate interest in analyzing user behavior on our website and thereby optimizing our offering both technically and economically. With Google Analytics we can detect errors on the website, identify attacks and increase profitability. The legal basis for this is Article 6 Paragraph 1 Letter f of GDPR (legitimate interests). Google also processes some of your data in the USA. We would like to point out that, in the opinion of the European Court of Justice, there is currently no adequate level of protection for data transfer to the USA. Google uses so-called standard contractual clauses (Article 46 Paragraphs 2 and 3 of GDPR) as the basis for data processing by recipients in third countries (primarily in the USA) or for data transfer there. These standard contractual clauses (“SCC”) are model forms provided by the EU Commission and are intended to ensure that your data complies with European data protection standards even if it is transferred to and stored in third countries (such as the USA). Through these clauses, Google undertakes to comply with European data protection standards even if the data is stored, processed and managed in the USA. These clauses are based on an implementing decision of the EU Commission.

Google also offers

https://tools.google.com/dlpage/gaoptout?hl=de

a so-called deactivation add-on along with further information on this. This add-on can be installed with the common Internet browsers and offers you further control over the data that Google records when you visit our website. The add-on tells the Google Analytics JavaScript (ga.js) that information about visits to our website should not be sent to Google Analytics. However, this does not prevent information from being sent to us or to other web analysis services. Of course, you can also find out whether and which other web analysis services we use in this privacy policy.

Links to other websites

Our online offering may contain links to other websites (particularly customer homepages) or to other services such as Facebook, Twitter, Instagram or YouTube. In this regard, the data protection provisions of the respective providers of the websites or services apply. We have no influence on whether they comply with the data protection provisions.

Social plugins

Our websites use links to social network services such as Facebook, Instagram and Twitter. These services are offered by the companies Facebook Inc., Twitter Inc. and co. ("providers"). Social plugins are not directly integrated into our websites, but rather links are only provided to the respective services of these network providers. If you visit a page on our website that contains such a link, your browser does not establish a direct connection to the Facebook, Twitter or Instagram servers. This means that no information (including your IP address) can be transmitted to the providers in the USA.

Only if you log in to one of the services can the providers directly assign the visit to our websites to your profile on Facebook, Twitter or Instagram. The information and data (including your IP address) are then transmitted from your browser directly to a server of the respective provider in the USA and stored there.

The purpose and scope of data collection and the further processing and use of the data by the aforementioned providers as well as your rights and setting options for protecting your privacy can be found in the data protection information of the respective providers.

Transfer of personal data to third parties

Data will only be passed on to third parties within the scope of the clauses described above and for the purposes described therein. Any further data will not be sent without your prior, express consent. However, we reserve the right to transmit data to third parties without consent if this is necessary to avert threats to public order or for criminal prosecution. If one of the latter reasons applies, the personal data you have provided will be passed on, in particular to the responsible law enforcement and supervisory authority. We will therefore not use your stored data for advertising or marketing purposes and will not sell it to third parties unless you give us your prior express consent.

SSL encryption

To protect the security of your data during transmission, we use state-of-the-art encryption methods (e.g. SSL) over HTTPS.

Timeliness of the privacy policy

The further development of our platform or the implementation of new technologies may result in the revision of this document. We reserve the right to change the privacy policy at any time with future effect.

We reserve the right to adapt or change this policy.
